Welcome to the Chuck It® Ball, Dog Toy website at chuckitball.com (the “Site”). This Site is operated by Chuck It Toys LLC (“Chuck It® Ball,” “we,” “us” and/or “our”). We want you to enjoy visiting our Site and using our products and services, including purchasing our innovative dog toys.

These Terms and Conditions (“Terms”) govern your use of this Site and any purchase or transaction made on the Site. Please read them carefully. By accessing, visiting or using this Site, use of any Chuck It® Ball product or service, or completing any transaction on this Site, you agree to be bound by these Terms as well as our Privacy Policy. If you do not wish to be bound by these Terms, please do not access or use this Site.

1. Use of Chuck It® Ball Site

The Chuck It® Ball name, logo and all product names, designs, images, and slogans are trademarks and service marks owned and used by Chuck It Toys LLC. You may not use any trademark or service mark from this Site without our prior written permission.

You may access, browse and use this Site and purchase Chuck It® Ball products sold on this Site solely for your personal, non-commercial use. You agree to comply with all laws, rules and regulations applicable to your use of this Site and any transaction made on this Site. You may not modify, copy, distribute, transmit, display, reproduce, publish, license, sell, create derivative works from, transfer, or otherwise use any content, code, data or materials from the Chuck It® Ball Site without our prior written consent.

We aim for this Site to be accessible 24 hours per day. However, we do not guarantee that this Site or any of its functions will be available or error-free at all times. Access may be limited due to maintenance or updates.

User Content

If at any time you submit, post, upload or otherwise make available content to this Site (“User Content”), you guarantee that you have the lawful right to submit the User Content and that it will comply with the requirements provided herein. 2. Purchasing Chuck It® Toys

Our Site allows you to purchase Chuck It® Ball dog toys and accessories. You must be at least 18 years old or the legal age of majority where you live to make any purchase on this Site.

Product images and descriptions posted on this Site are for representation purposes only and may not accurately depict the actual product. We make reasonable efforts to accurately display all attributes, specifications, colors, and details of our products. However, the actual product you receive may vary slightly.

All prices and availability of products are subject to change without notice. We reserve the right to limit quantities available for purchase. If a product becomes unavailable after you place your order, we will attempt to contact you to give you the option to modify or cancel your order. If you choose to cancel your order and you have already been charged, you will receive a prompt refund.

To complete any purchase on this Site, you must provide a valid credit card number and associated payment information. By submitting your purchase order, you represent that you are authorized to use the payment method provided. If your payment method fails or your order is otherwise unable to be completed, we will attempt to contact you using the contact information provided at checkout.

Once your payment is authorized, Chuck It® Ball will process your order for shipment. We will make reasonable efforts to ship your order according to our estimated timeframes. However, actual ship times may vary due to high demand, materials shortages or other factors. If there will be an extended delay in shipping your product, we will attempt to contact you using the contact information provided during checkout.

Title and risk of loss for purchases made on this site will pass to you when the products are delivered to the carrier. We strive to ensure safe delivery of your purchase, but we will not be held responsible for lost or stolen packages.

Returns/Exchanges

If you are not fully satisfied with your Chuck It® Ball purchase, most products can be returned for an exchange or refund within 30 days of receipt, subject to the exceptions below.

To be eligible for our Return/Exchange program, products must be returned in new, unused and undamaged condition. We cannot accept returns on products that have been damaged or altered in any way. All components and original packaging must be intact for return.

Custom or personalized products are nonrefundable. Chew toys or products showing signs of wear and tear from pet use are not eligible for return/exchange.

To initiate a return/exchange, please contact us to obtain a Return Merchandise Authorization (RMA) number. Provide the RMA number on the outside of your return package and ship the product back to the address provided at your own expense.

Upon receiving your returned product, we will process your exchange for the same item or provide a refund. Refunds may take 1-2 billing cycles to reflect on your statement, depending on your card issuer’s policies.

3. Feedback and Complaints

We appreciate hearing from our customers about how we can improve your experience. If you have any feedback, questions or complaints, please send us a message through our Contact Page. A Chuck It® Ball representative will respond shortly.

If there is any dispute arising from your use of this Site or any transaction made on the Site, we encourage you to contact us directly to seek resolution. We will seek to resolve any disputes in good faith and in a reasonable and cost-effective manner.

Chuck It® Ball and its owners, directors, officers, employees, representatives, contractors and agents shall not be liable to you or any third party claiming through you for indirect, incidental, special, reliance, consequential or punitive damages arising out of this agreement, your access to or use of this site, or any linked site, including without limitation, loss of business profits, loss of business opportunity, business interruption, loss of goodwill or reputation, or your inability to use this site, even if Chuck It® Ball is expressly advised of the possibility of such damages.

In no event shall the aggregate liability of Chuck It® Ball, its owners, directors, officers, employees, representatives, contractors and agents arising under any cause of action related to these terms, the site, or any products purchased on the site exceed the total amount paid by you, if any, in accessing or using this site.

These Terms and any dispute arising from your use of this Site or any purchase made on this Site shall be governed by and construed in accordance with the laws of the State of Kansas, USA, without giving effect to principles of conflicts of law. Any legal proceedings against Chuck It® Ball related to these Terms or the Site must be brought in the federal or state courts located in Wyandotte County, Kansas, USA and you hereby irrevocably consent to the exclusive personal jurisdiction and venue therein. If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be deemed severable and will not affect the validity or enforceability of the remaining provisions.
